Terms of Use

These Terms of Use (“Terms”) govern your access to and use of Analytics TV, operated by Food Drink Life Inc. (“Analytics TV,” “we,” “us,” or “our”). By accessing your account or otherwise using Analytics TV, you agree to these Terms. If you do not agree, please do not use Analytics TV.

Who may use the service

Analytics TV is intended for website owners, publishers, and the team members they authorize to help manage their sites.

Analytics TV is intended for users aged 18 or over. By using Analytics TV, you confirm that you are at least 18 years old.

Analytics TV is available worldwide, subject to applicable laws and to any geographic restrictions we may need to impose. Availability in a location does not mean every feature is available or lawful in every jurisdiction; you are responsible for complying with the laws that apply to you.

Account responsibility

You are responsible for keeping your account credentials confidential and for activity under your account. Tell us promptly at [email protected] if you believe your credentials or account security have been compromised.

Connecting third-party services

Analytics TV lets you connect third-party services, such as Google Analytics and Google Search Console, so we can display your own site’s data inside the dashboard. When you connect a third-party service, you authorize Analytics TV to access the data made available through that connection for the purpose of providing Analytics TV’s features to you. Your use of any connected third-party service remains subject to that service’s own terms.

For Google specifically, you connect by signing in with Google and granting read-only access to your Google Analytics and Search Console data. No permission you grant lets Analytics TV change anything in those properties. You can disconnect at any time in Analytics TV, or review and revoke access at myaccount.google.com/permissions.

The third-party services you can currently connect to Analytics TV include Google Analytics and Google Search Console; Microsoft Clarity, read using credentials configured for that Clarity project; and Kit (ConvertKit), read using a Kit API key configured for that site. Analytics TV may also read published content from the WordPress sites you connect, as a data source for its features.

Where a Kit (ConvertKit) account is connected for a site, Analytics TV reads that account’s statistics only: newsletter and audience performance, the newsletters you have sent, your opt-in forms, your automated sequences, and, where you use Kit Commerce, your product-sales figures. Analytics TV does not read your subscriber list and does not receive the identity of anyone who buys one of your products.

Analytics and revenue estimates

Analytics TV displays traffic, search, reader-behavior, revenue-estimate, newsletter, and AI-assisted analytics based on the data sources you connect. Revenue figures shown in Analytics TV are estimates calculated from figures you supply: site earnings from your session counts multiplied by an RPM you provide, and the estimated earnings shown against an individual newsletter from that newsletter’s clicks using the same RPM. They are not statements of actual earnings from any ad network, and Analytics TV has no visibility into your actual ad network revenue. You are responsible for verifying financial figures against your ad network or other authoritative source before relying on them.

AI-generated analysis and recommendations

Analytics TV may generate recommendations, summaries, or answers using AI, based on the data you’ve connected. These are provided to help you understand your own data faster. They are not professional, financial, legal, or business advice. AI-generated analysis can be incomplete or contain errors, and you remain solely responsible for the business and editorial decisions you make, whether or not you use Analytics TV’s recommendations.

Team access and permissions

If you invite team members to your Analytics TV account, you can scope what each person can see, for example limiting a team member to specific sites, or adjusting whether they can see revenue estimates. What a team member can access is determined by the permissions assigned to them, not by a fixed role such as “account owner.” You are responsible for managing who you invite and what access you grant them.

Acceptable use

When using Analytics TV, you agree not to:

  • Access or attempt to access data, sites, or accounts you are not authorized to access
  • Interfere with, disrupt, or attempt to gain unauthorized access to Analytics TV or its underlying systems
  • Use Analytics TV to violate any applicable law
  • Misuse the AI Ask feature to attempt to extract, abuse, or attack the underlying systems
  • Resell, sublicense, or otherwise make Analytics TV available to third parties as your own service
  • Scrape, harvest, or use automated or bulk methods to extract data from Analytics TV, except through features we provide for that purpose

Intellectual property

Analytics TV, including its design, software, and branding, is owned by Food Drink Life Inc. You retain ownership of the data from your own connected sites and accounts; Analytics TV does not claim ownership of it.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Analytics TV service and software for your own business purposes. This license is to the Analytics TV service and software only. It does not restrict your own data or the outputs generated from it: you keep the right to use, copy, share, and act on the reports, analyses, and AI-generated answers that Analytics TV produces from your own data.

Third-party services we rely on

Analytics TV relies on third-party services to provide its features. We are not responsible for outages, changes, or errors in those third-party services that are outside our control.

The providers Analytics TV currently depends on to operate include Google (Analytics, Search Console, and the web fonts loaded by the Analytics TV application), Microsoft (Clarity), Anthropic (the AI Ask feature), Render (application hosting and our primary account database), Neon (a separate database used for site-tracking data), Postmark or a configured alternative email provider (transactional and account email), and Kit / ConvertKit (newsletter, audience, form, automation and Kit Commerce statistics, when connected). Analytics TV reads aggregated behavior data from the customer’s configured Microsoft Clarity project using credentials configured for that project. We do not integrate with any ad network.

Availability and changes to the service

We may update, modify, or discontinue features of Analytics TV at any time. We are not responsible for temporary unavailability caused by maintenance, third-party outages, or circumstances outside our control.

We do not offer a service-level or uptime commitment. We aim to keep Analytics TV available and reliable, but we do not guarantee that it will be uninterrupted or error-free.

Account suspension or termination

We may suspend or terminate your access if: you materially breach these Terms; you misuse the service; there is a security threat; there is unlawful activity; payment is due and not made (where payment applies); or your conduct creates a material risk to Analytics TV, its users, or others. Where practicable, we will give reasonable notice before suspending or terminating. We may suspend or terminate immediately, without prior notice, where reasonably necessary to protect security, address abuse or fraud, meet a legal or regulatory obligation, or prevent material harm. We act proportionately and limit any suspension or termination to what is reasonably necessary.

To close your account, contact us at [email protected]. Analytics TV does not yet have an automated, self-service account- or data-deletion process. We cannot currently promise that closing your account immediately or automatically deletes your stored data, including data from connected services or AI Ask history. That capability is still being built. Disconnecting a third-party service such as Google does not, by itself, delete data Analytics TV has already stored from that connection. This section will be updated with the actual deletion process and timeline once it exists.

Disclaimers

Analytics TV is an analytics and business-information service. It brings together data from the services you connect, from your own site’s first-party tracker, and from figures you enter, and presents that information back to you with analysis and estimates. This section describes the limits of what we can promise, so please read it carefully.

Analytics can be delayed, incomplete, or revised. The figures you see depend on third-party sources such as Google Analytics, Google Search Console, Microsoft Clarity, and Kit, on your own tracker, and on our processing. Those sources can be delayed, sampled, incomplete, or corrected after the fact. Figures in Analytics TV may differ from the figures shown in the source platforms and may be revised after they first appear.

Estimated earnings are estimates. Any earnings or revenue figures in Analytics TV are calculated from your traffic or newsletter activity and an RPM figure you provide. They are not measured payments from any ad network or other income source, and they may differ materially from what you are actually paid. Do not rely on them for accounting, tax, or financial reporting.

AI-generated answers can be wrong. Answers, insights, and recommendations produced by AI features are generated automatically from your data. They can be inaccurate, incomplete, or out of date. Review them before you rely on them, and use your own judgment when making business decisions.

Analytics TV is provided “as is” and “as available.” Except as expressly stated in these Terms, and to the fullest extent permitted by law, we make no other warranties, conditions, or representations of any kind, express or implied, including any implied warranties or conditions of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that Analytics TV will be uninterrupted, secure, or error-free, or that any data, estimate, or AI-generated output will be accurate or complete.

Nothing in this section excludes or limits any warranty, condition, or right that cannot lawfully be excluded or limited. If the law where you live gives you rights that cannot be waived by contract, those rights are not affected by these Terms.

Limitation of liability

To the fullest extent permitted by law:

We are not liable for indirect or consequential loss. Neither Food Drink Life Inc. nor its directors, officers, employees, or contractors will be liable to you for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, business, goodwill, anticipated savings, or data, arising out of or in connection with these Terms or your use of Analytics TV, however caused and even if we were advised of the possibility of that loss. This includes decisions you make in reliance on analytics, estimates, or AI-generated content in Analytics TV.

What this section does not limit. Nothing in these Terms excludes or limits liability for fraud or fraudulent misrepresentation, for death or personal injury caused by negligence, or for any other liability that cannot be excluded or limited under applicable law. If you use Analytics TV as a consumer under the law where you live, nothing in these Terms affects the statutory rights you have as a consumer that cannot be waived by contract. Where the law does not allow a limitation in this section to apply in full, it applies only to the fullest extent the law allows.

Governing law

These Terms, and any dispute or claim arising out of or in connection with them or with Analytics TV, are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules.

You and we agree that the courts of Ontario, Canada have exclusive jurisdiction over any such dispute, and each of us submits to that jurisdiction. Either of us may, however, seek injunctive or other urgent relief in any court of competent jurisdiction to protect intellectual property, confidential information, or data security.

Before starting formal proceedings, please contact us at [email protected]. We will try to resolve any dispute with you informally first.

If you use Analytics TV as a consumer under the law where you live, this section does not deprive you of the protection of mandatory provisions of that law or of your right to bring proceedings in the courts of the place where you live.

Changes to these terms

We may update these Terms from time to time. If we make material changes, we’ll update the date at the top of this page.
